While at his NTC rotation PFC Thiel was tasked by SFC Graff with being at the trucks at 0630 to begin the duty day. PFC Thiel along with a few others were late to the trucks. As a result everyone in the company lost the privilege of going to the shoppete to get supplies by punishment of SFC Graff. While on guard duty the night before going to the field PFC Thiel was unable to clean his weapon because he did not have a weapons cleaning kit. SSG Gaburri told PFC Thiel to go and buy a weapons cleaning kit and a few other things at the shoppete. SSG Gaburri was at the same formation where SFC Graff had issued the order of, “no one is allowed to go to the shoppete while we are at NTC.” PFC Thiel did remind SSG Gaburri that neither of them was allowed to go to the shoppete as ordered by SFC Graff. SSG told his soldier that it was not that big of a deal and to go anyway. While on his way back to the trucks PFC Thiel went to get his flashlight were he got caught going to the shoppete by SFC Graff. PFC Thiel thought it was ok because he was told to do so by SSG Gaburri. But it was not ok to go to the shoppete because SFC Graff out ranked SSG Gaburri. PFC Thiel was in direct violation of Article 92 – Failure to obey order or regulation. Article 92 covers anyone who violates or fails to obey any lawful general order or regulation, having knowledge of any other lawful order issued by a member of the armed forces, which it is his duty to obey, fails to obey, fails to obey the order, or is derelict in the performance of his duties; shall be punished as a court-martial may direct. First, any person subject to this chapter who violates or fails to obey any lawful general order or regulation.
