An "emergency medical condition" is a condition manifesting itself by acute symptoms of sufficient severity, such as severe pain, for which the lack of immediate medical attention could reasonably be expected to result in placing the patient in serious jeopardy, serious impairment to bodily functions, or serious dysfunction of any bodily organ or part (Smith 2002, page 427)
According to Pozgar (2012). The Emergency Department is a critical area among hospitals and a target for lawsuits. Studies reported that 70% of the lawsuit occurred at the ER is due to negligence and poor follow-up care. The first objective and obligation consist on to provide the appropriate medical screening for patients requesting care and the second objective refers to the stabilization requirement. Indeed, to comply with EMTALA, a participating hospital must first provide an appropriate medical screening examination within the capability of the hospital's emergency department to determine whether an emergency medical condition exists.2 This "screening" requirement is triggered if any person "comes to the emergency department" and a request is made on the individual's behalf for examination or treatment for a medical condition (Smith 2002, page, 426). A hospital satisfies its duty, providing care for those patients requesting care and treatment in the hospital premises, including the ambulance own for the hospital that is not on the Hospital ground, however the hospital does not have EMTALA obligations for the patients that are in an area (250 yards radio) that are not part of the hospital (Smith, …show more content…
Finally, I would like to emphasize in patient’s education. Patients should understand that the role of an emergency room is to provide care for Life-threatening illness. Patients that come to the emergency room for the wrong reason, could harm those patients experiencing an emergency

Based on these findings the defense argument, that the patient was not transferred to another facility nor did they attempt to transferred the patient to another facility does hold some credence. According to Zibulewsky, (2001)The initial intent of EMTALA was to ensure nondiscriminatory access to emergency medical care. The mere fact that the physician recommended follow-up at an outside facility after adequately evaluated and treating the patient, would not be an EMTALA violation. However, refusing to see the patient back in the future when she was in active labor, clearly would be an EMTALA violation. Because of the distance to Galveston, it is unreasonable to assume that the patient could without exception make it to another facility for delivery. On reviewing the case and other associated evaluations performed by Memorial Hospital, it becomes clear that the hospital has established a pattern of not managing indigent patients and was involved in the practice of diverting them to other facilities. Based on these findings it appears that several infractions of the EMTALA have been committed by the facility. Whether the case in question falls strictly under these guidelines it is unclear. I believe part of the court's decision to find against the defendant was the result of the pattern of behavior that was established by the facility and the treating physician. Because there is clear violation of EMTALA, further action should be taken by the medical review board.
